The case was brought by New Mexico Attorney General Raúl Torrez, who accused Meta of violating the state’s consumer protection laws by promoting Facebook, Instagram and WhatsApp as safe for young users while allegedly allowing harmful content and predatory behaviour to persist. Jurors agreed, concluding that the company engaged in deceptive and “unconscionable” practices, ultimately counting tens of thousands of violations that resulted in the financial penalty.

Central to the case was a 2023 undercover investigation by state authorities, who created accounts posing as children under 14. These accounts were quickly exposed to explicit material and contacted by adults seeking inappropriate interactions, evidence prosecutors used to argue that Meta’s safeguards were insufficient.

Meta has rejected the findings and said it will appeal. The company maintains it has invested heavily in safety systems and argues that moderating harmful content at scale remains a complex challenge.

Beyond the immediate financial penalty, the case carries broader implications. A second phase of proceedings is scheduled for May, where a judge will consider whether to impose additional fines and mandate changes such as stricter age verification and improved removal of harmful users.

The ruling comes amid a wave of lawsuits across the United States targeting social media companies over their impact on children’s safety and mental health. Legal experts say this verdict is significant because it challenges long-standing protections that have shielded tech firms from liability for user-generated content. By focusing on platform design and corporate conduct rather than individual posts, prosecutors were able to sidestep some of those legal defences.

For Meta, the financial hit is manageable given its size, but the reputational and regulatory risks are far more serious. The case underscores a shifting legal landscape in which governments are increasingly willing to hold platforms accountable not just for what users do, but for how their systems enable harm.

More broadly, the verdict signals that the era of light-touch regulation for social media may be ending. If upheld on appeal, it could embolden regulators worldwide to pursue similar actions, forcing platforms to rethink how they balance growth, engagement, and user safety—particularly for their youngest users.
